Gross Miscarriage of Justice: Yakub Memon Deserves a Reprieve

These are the Views of Justice Katju

I believe there has been gross travesty of justice in the case of Yakub Memon.

I have carefully studied the judgment of the Court. The evidence on which he has been found guilty is very weak. This evidence is (1) retracted confession of the co-accused, and (2) alleged recoveries.

As regards the first, everyone knows how 'confessions' are obtained by the police in our country--by torture. And torture is such a terrible thing that one will confess to anything under torture. Joan of Arc confessed to be a witch under torture. Moreover, in this case, the alleged 'çonfession' was retracted.

As regards 'recoveries', anyone having even the slighted knowledge of the working of the police knows that such alleged recoveries are often planted. The truth is that our police usually cannot nab the real culprits because it is not trained in scientific investigation, and yet it has to solve the crime. So the best thing to do in terrorist cases is to implicate half a dozen Muslims, since it is well known that Muslims have nothing else to do except throw bombs.

As regards the judiciary, I fear it is becoming increasingly populist. Many judges want to show to the public that they are 'tough on terror', never mind if innocent people are convicted and hanged...

Narendra Modi and the 12th House: Saturn There Foretells Doom

Narendra Modi is the Prime Minister of India. His rise has been meteoric and within a short time he is prime minster of India. In the modern age Modi has been able to market himself with cliches and slogans that appealed to the masses. Perhaps even when he was mouthing these cliches, he very well was aware that he would not be able to honor any of them. This is Modi's Achilles heel and perhaps it has something to do with his horoscope.

I will not go into details of Modi's horoscope as that is not the within the purview of this article. I will however bring out that 12th house of Modi which has Saturn. This  in the west is known as the Napoleonic house. The great Napoleon had saturn in his 12th house.

What does this show ? It means that Modi like Napoleon will have a quick rise. This has happened and within a decade he is PM of India. Napoleon also had a meteoric rise and then something singular happened.

Saturn shows a precipitous downfall. Napoleon was defeated at Waterloo and suffered an ignoble defeat. I am afraid the position of saturn in 12th house portends the same for Modi. He will have a precipitous fall and then all the kings horses and all the kings men will not be able to put Modi together again. Let is and wait and see how astrology unfolds for Modi.

Justice Katju Feels Kejriwal is a Fraud

Posted: 21 Jul 2015 01:32 AM PDT

I have been in Delhi for two days now after my return from abroad. What I have heard and seen in these two days has only confirmed my earlier opinion ( I had called him a 'Sapnon ka Saudagar' ) that this fellow Kejriwal, this 'miracle man', who was depicted as a solution to all of India's problems, this ' Imaandari ka Masiha ', is a total fraud and a demagogue.

Many people met me in these two days. Most of them were earlier strong supporters of Kejriwal, but they are now totally disenchanted and disillusioned by his actions. They said that his removal of co-founders of AAP Prashant Bhushan and Yogendra Yadav shows that Kejriwal behaves like a dictator, and is not willing to tolerate dissent and disagreement in AAP. They told me that conditions in Delhi have gone from bad to worse under his rule, despite his so called ' achievements '.

For two days I have been seeing on T.V. advertisements mentioning ' his achievements ' (" Woh pareshan karte rahe, hum kaam karte rahe " ). But why have these alleged 'achievements' to be advertised ? It costs a huge amount of money getting these advertisements publicized on T.V. This money could have been spent on the welfare of citizens of Delhi.. And the best advertisement is one's deeds, not publicity in the media.

The way AAP leaders misbehaved with the Delhi Police Commissioner Bassi and humiliated him shows that they are looking for a scapegoat to divert public attention from their failures and to score brownie points

J & K High Court Rules Kashmir is a Soverign Entity

On 17th July 2015 a landmark judgment was given by the Jammu and Kashmir High Court by a division bench of 2 judges. The judges in a 76 page judgment observed that central laws could not be made applicable to the state of Jammu and Kashmir  without the consent of the  J and K assembly and legislature. The court observed that the final authority which could govern the state was the J an dK assembly and the government and the law to be followed was the one enacted by the Maharajah of Kashmir as per the 1939 constitution.

The High Court made a significant statement that Kashmir was a sovereign state with a separate constitution and flag. This is a far reaching judgment and is based on earlier judgments of the Supreme Court.

In real terms this violates the principle of India as a single entity and throws open the status of Kashmir. All these problems would have been solved in case Nehru and the Congress party had no enacted the Article 370 and made it a part of the Indian constitution.

One cannot forget that the problem of the Chakma hill tribes in Bangladesh was solved to a great extent with the settlement of Bengali Muslims in the Hill tracts of Chittagong, where the Chakama’s reside. In contrast we in India are committed to maintain the demographic profile of the state with Kashmir being out of bounds to Indians from other states. Thus a Frankenstein has been nurtured and the Indian state is paying dearly for its mistakes. God save India

Kejriwal wants Delhi Police under him. It's like throwing Red Herring

Arvind Kejriwal has repeatedly said that the Central Government should hand over control of the Delhi police to the Delhi state government. His motives are not sincere and he is not aware of the constitutional provisions which cannot allow the Delhi police to come under the Delhi state government.
What are the provisions? Lets have a look at them. Clause 3(a) of Article 239AA of the Indian Constitution, by which the NCT of Delhi was constituted, says that the power to make laws regarding the Delhi police is with Parliament. And the executive power is co-extensive with the legislative power.vide Article 162.
So it will require a Constitutional amendment to hand over the power over the Delhi police to the Delhi state government. Such an amendment requires two third majority of members present and voting in each House of Parliament, vide Article 368. It cannot be done by the Central government even if it wants to. This is the law of the land and has to be followed
So who is Kejriwal trying to befool ? Does he think that because most people do not know the law he can deceive the public ?. This man as I have earlier said is a charlatan. Its about time the famous quote of Field Marshal Sam Manekshaw is applied to him. He had stated " Those who talk by the mile and perform by the inch, deserve a kick by the foot".

Narendra Modi is a Narcissist; Can he Lead India Forward , No *

When I heard and read as well as saw photographs that Narendra Modi wore a a Rs 9 lakh suit to receive Obama, the US president , it struck me that here is  man who is not only vain, but more in love with himself. The US President commented that Modi was like a Mumbai film star. We have not seen or read of such costly dresses being worn by simple plebian leaders of people , though royalty is an exception. One can associate such a dress with the pomp and show of a king or empress, but certainly not with a plebeian leader.

Modi has some serious identity problems. He claims he is a backward caste to win  votes, but again his antics and to use the words in hindi " Harkat" , are not of a man belonging to a lower strata of society. Could be, he uses his back ward caste origin only for votes and has no real empathy for the downtrodden and destitute. In case he was really concerned would he give 3 billion dollars gratis to nations like Bangladesh and Mongolia, from we may get nothing in return.?

Modi has lead the party, the BJP on some glib slogans. These slogans are what they are, simply hollow and meaningless. A look at his slogans and speeches and the promises he has mad will make a man die laughing on a bed of nails. A few choice ones are brought out  below

>  I will not allow corruption, nor will I allow anybody else to benefit from corruption
>  I will ensure that One Rank One Pension is sanctioned forthwith
>  I will ensure that proprietary is maintained in Public life

There are many more, which Modi has only mouthed, because it suited him. Perhaps that is the game of all politicians , but certainly not the stuff which leaders who make a name in history indulge in. Obviously Modi will not be a mover or shaker in world history and his aim seems to be to just live life in a regal manner and look sombre and serious. It's a mask and those who  wear a mask are always seen for their true worth later on.

Let me advice Mr Modi that he has Saturn in his 12th house, showing meteoric rise and precipitous fall. It's known as the house of Napoleon and we all know what happened to Napoleon. So the future and God may yet cut Modi to size.

The BJP is a Carbon Copy of the Congress

When Narendra Modi was campaigning and shouting his crusade against corruption and promising " Ache Din" we all believed him. Here we thought is a messiah who will rid India of corruption and nepotism.
However what has happened has made us hang our heads for voting Modi and the BJP into power in shame. It is difficult to comprehend that the same Modi who in speech after speech ridiculed :"Jijaje" ( brother in law of Rahul Gandhi) was in reality himself a charlton.

One has only to see that there is a big scam running in the Madhya Pradesh government for at least 7/8 years and during this time the party in power was the BJP. Crores have been swindled and what is known as swayam  scam and yet the Chief Minister sits smug. Caesar and Caesar's wife must be above suspicion and despite this famous saying Shivraj Singh carries on shamelessly and we watch, that Modi is tongue tied.

The BJP has also seriously compromised on culpability and proprietary. We have the Foreign Minster hobnobbing with a known wheeler dealer and another lady vasundhara Raje in cahoots with the same swindler. He is wanted by the investigating  agencies and is hiding in london with an umbrella on his head and helped by  Modi's own party and cabinet ministers,\

Look at the back tracking on One Rank One Pension( OROP) and we know that Modi is going to lead India nowhere.  Its about time this man was dumped like a ton of bricks .  India needs a better man

What Justice Markandey Katju( Supreme Court Judge) Feels on the National Anthem

A controversy is going on whether Tagore wrote ' Jana Gana Mana ' in honour of the British King George the Fifth who visited India in 1911. In this connection I had supported this view in my fb post and blog, giving my reasons.

Those who wish to refute me should point out the flaws in my reasoning. You cannot demolish a reasoned argument by mere assertions without giving reasons. So I am reproducing my post, and invite reasoned comments :

The British stooge Tagore and the National Anthem

There is a controversy as to whether the Indian National Anthem 'Jana Gana Mana ' was written by Rabindra Nath Tagore  in praise of God, or as sycophancy in praise of the British King George the Fifth.

In my opinion the evidence is strongly in favour of the second view.
To explain, let me first quote the English translation of the song :

" Victory to thee, O ruler of the minds of the people,
O Dispenser of India's destiny.
Thy name rouses the hearts of Punjab, Sindh,
Gujarat and Maratha,
Of the Dravida, Odisha and Bengal;
It echoes in the hills of the Vindhyas and Himalayas,
mingles in the music of Yamuna and Ganges and is
chanted by the waves of the Indian Sea.
We get up with your blessed name on our lips
We pray for your auspicious blessings
Thou dispenser of India's destiny.
Victory, victory, victory to thee."

Now a few things must be noted about this song :

1.The song was composed at precisely the time of the visit of the British King George the Fifth and Queen Mary in December, 1911

2.The poem does not indicate any love for the Motherland.

3. The ' Adhinayak ' ( Lord or Ruler ) is being hailed. Who was the ruler of India in 1911 ? It  was the British, headed by their King-Emperor.

4. Who was the ' Bharat Bhagya Vidhata ' ( dispenser of India's destiny) at that time ? It was none but the British , since they were ruling India in 1911.

5.The song was sung for the first time in India on the second day of the Calcutta Conference of the Congress Party in December 1911. This Conference was held specially to give a loyal welcome to King George the Fifth, and to thank him for annulling the Partition of Bengal in 1905.

6. The agenda of the second day of the Calcutta Conference , in which the song was sung, was specially reserved for giving a loyal welcome to George the Fifth, and a resolution was adopted unanimously that day welcoming and expressing loyalty to the Emperor and Empress.

7. It was only as late as in 1937, when he wanted to show himself as a patriot, that Tagore denied that he had written the song to honour the British King

The above facts almost conclusively prove that ' Jana Gana Mana ' was composed and sung as an act of sycophancy to the British King.

OROP will Not Come until the Top Brass Acts

I am constrained to observe from many thousands of miles away that there is no tangible progress on the demand of OROP. Now I am told the government is willing to grant OROP to major generals and not anybody else. Frankly, months back I had written that OROP will not come and at that time many had said I was wrong. I maintain that petitions signed with blood, returning of medals etc is a futile exercise and leads nowhere. Even at the risk of being branded an apostate, I will say that these relay fasts have no relevance to the real situation
It’s about time we identify the real problem (I have been stating this in my posts on my blog). The real problem is the complete dereliction of responsibility by the COAS( as others don’t matter). The COAS  has been unable to exert himself. I fail to understand what is his fear ?. The only way OROP will come is if the COAS intervenes and resigns from the post. But to do this it requires guts and a vision of history. Does the present COAS have that, as his own words that OROP is sanctioned are not honored? And still he sits in his chair.
If you look at the past, right from Cariappa and Maneckshaw( yes sir, Maneckshaw) did precious little for the soldier.  Cariappa set the ball rolling when he agreed for the down gradation of the post from Cin C to COAS.Manackshaw had no vision to ask for anything for the officers like lateral induction in civil services. In fact generals like Bewoor agreed for reduction in pension from 70% to 50%.

The way forward is to pressurize the COAS to act and start a dharna outside the homes of the generals and the Colonels who are in cahoots with the BJP, not forgetting the army chief. If these men cannot act all that will come are some crumbs and these generals will say “yes sir, something is done”.

A word about the generals sitting in Dharna and fasting. It’s nice, but what use is it? Why were they silent when they sat in the chair?

The Biggest Shopping Super Shopping Chain in Middle East ( UAE) is Owned by Indian

It is surprise to me that the largest chain of supermarkets in the Middle East is owned by an Indian .He is Yusuffali M.A who hails from Nattika in Thrissur district of Kerala. He is the Managing Director. Yusuffali was born in 1995 and came to Dubai. He opened his first store in 1995. He is the largest employer of Indians outside India. He has a chain of super markets spread all over the Middle East. He has now opened one supermarket in Kerala India also.

The success of Yusuf Ali can be gauged from the fact that Forbes ranks him as the 39th wealthiest Indian and the 974th richest in the world. His personal wealth is estimated at $1.6 billion

The supermarkets go under the name “Lulu” and are massive markets dishing out thousands of products from eats, to TVs and readymade clothes to cooked meals. Truly it’s an experience to shop at one of his hyper stores and there are 105 of them
